Résumé :
|
It is often said that an arbitral award is worth only as much as the ability to secure its enforceability. To the extent the vast majority of prayers for relief in arbitration are for money damages, an arbitral award granting damages is worth only as much as the ability to obtain payment, voluntary or compulsory, of such damages. Evaluation of Damages in International Arbitration, this Dossier IV, the newest Dossier prepared by the ICC Institute of World Business Law, provides a comprehensive overview of the difficulties encountered by arbitrators, governments and international organizations in assessing and calculating the amounts of recoverable damages in international arbitration disputes. The present volume is comprised of ten chapters written by expert arbitrators and practitioners, many of whom are affiliated with the ICC International Court of Arbitration. Each contributor has written a chapter addressing the key issues and practical solutions in evaluating and recovering damages for these specialized disputes. The contributors are: Serge Lazareff Richard H. Kreindler Paul-A. Gélinas Alexander S. Komarov Jan Paulsson Yasuhei Taniguchi Jacques Werner Hugo Perezcano Diaz Nayla Comair-Obeid Henry Weisburg Christopher Ryan Vivian Ramsey Bernard Hanotiau Yves Derains Serge Lazareff, distinguished Member of the Paris Bar, has been Chairman of the ICC Institute of World Business Law since 1999. With the publication of Evaluation of Damages in International Arbitration, the ICC Institute fulfils its dual mission: training and acting as a think-tank for the International Chamber of Commerce, particularly in the field of arbitration
